Important Update: Revised Form I-129 Now in Effect

Posted On January 17, 2025

On January 17, 2024, USCIS released the 01/17/25 edition of Form I-129, Petition for a Nonimmigrant Worker, which incorporates changes from the recently announced H-1B and H-2 modernization final rules.

Since there is no grace period for this new form, USCIS will reject any outdated versions of Form I-129 received on or after Jan. 17, 2025. Here’s what you need to know:

▶️ If you file by mail before Jan. 17, 2025: USCIS will accept the 04/01/24 edition of Form I-129.

▶️ On or after Jan. 17, 2025: USCIS will not accept the 04/01/24 edition. USCIS will only accept the 01/17/25 edition.

If you’re an employer or immigration professional preparing H-1B or H-2 petitions by mail, be sure to download and use the latest Form I-129 right away to avoid rejections.

Stay informed and plan ahead to ensure a smooth filing process. For more details, visit the official USCIS website (https://www.uscis.gov/i-129) or contact our office (team@evelynmoon.com) to schedule a consultation.
